Legal Adviser - Banking Legal Assistance
The Attributions of the Legal Adviser of MBR in the field of banking legal assistance:

*provides, at request, legal assistance regarding the financing operations and transactions;

*participates to the definition, elaboration and approval of banking products and of the internal regulations in this sense;

*elaborates, updates and approves bank's contractual standards;

*approves, from legal point of view, the modifications of the approved contractual standards;

*takes part, at internal clients' request, in any operation of high complexity level, to financing contracts' negotiation and approval;

*checks the financing legal documentation regarding bank's clients, according to the competences, and at request, the legal documentation for opening an account;

*legally approves and issues legal opinions about bank's financings and engagements;

*offers legal assistance regarding the guarantees made in bank's favor;

*advices about the correct and unitary application of legal provisions;

*ensures the organization of seminars and courses with legal thematic, at bank's departments' request.
Requirements

*Excellent knowledge of the country's legal framework including the banking legislation

*Respecting the professional confidentiality

*The capacity of respecting deadlines imposed

*Computer skills

*Interpersonal skills
Qualifications

*Graduate in Law, with legal banking experience of at least 1 year and excellent technical knowledge

*Excellent knowledge of English language and Computer skills

Legal Adviser - Litigations Assistance
The Attributions of the Legal Adviser of MBR in the field of litigations assistance:

*at internal clients' request, examines the pre-litigious/litigious situations and proposes solutions regarding the protection and defense of bank's interests;

*in collaboration with bank's competent departments and on grounds of the information send by them, ensures the prevention and limitation of litigious/pre-litigious situations in which bank is involved or can be involved;

*examines the legal complaints/reclamations, proposing, together with other involved departments and based on the information provided by them, measures in order to solve them.

*administrates the legal jurisprudence, realizing the main orientations of all legal councilors from bank;

*provides the legal assistance and the correspondence with creditors and other authorities and public institutions regarding the initiated sequester for bank's clients;

*edits the actions, request, objections, complaints, memoirs, and other such specific documents, formulates the ordinary and extraordinary attack ways and fulfills any jurisdictional or procedural acts, except when transferred to external lawyers;

*participates to negotiations/conciliations for solving on amiable way the pre-litigious/litigious situations, in the limits of the mandate granted by bank's leading committee.

*Coordinates, advices and controls the external legal activities (lawyers' network, judging executors offices, other external resources) following up the evolution of the litigious files and their solving method;

*Administrates the informatics application - data base regarding the litigations' evidence, and makes, at internal clients' request, reports and studies regarding the litigious/pre-litigious files in which the bank is involved or can be involved;

*Informs, based on the decision of bank's management, the penal bodies about the fraud cases within or in connection with the bank, and in this view makes penal complaints, and if it is the case, makes sure that the bank constitutes a civil part;
